RAB chief has given a call asking lawyers not to come forward to legally represent any accused terrorist in the court. Some days ago, this RAB head demanded the Safe Food Act be sent back to the Parliament and the provision of capital punishment added to it through an amendment. He even said, no punishment except the death penalty works effectively in Bangladesh.
He heads an elite law enforcement agency and he is seeking capital punishment for such offence. He is also asking the lawyers not to extend legal assistance to any accused terrorist. There is no doubt that he is devoid of any basic notion of law, state and human rights and citizens’ rights. Since people in Bangladesh are scared of RAB, nobody dares to criticise such unconstitutional and ridiculous statements of the chief of this force.
Every citizen has the rights to be able to avail legal assistance in the court. By making the latest statement the RAB chief has given a call to deprive the citizens of their fundamental rights and placed himself above the Constitution. This imprudence is intolerable.
A lawyer extends legal assistance to an accused not to prove that he is innocent, but to establish his legal rights.
An accused is viewed as innocent until a court finds him guilty. The accused is brought to court to prove whether he is guilty or not. One who is being sent to court after being accused as a terrorist indeed stands a high chance to be acquitted of the charges. Hundreds of thousands of people get acquitted in courts across the world this way.
RAB chief does not feel satisfied when people accused as terrorists by his force and other law enforcement agencies get acquitted in court. That’s why they often kill people in so-called crossfire. Some of the fortunate ones, who manage to stay alive, land in court. Now, the RAB chief is on a campaign to rob them of their constitutional rights by asking the lawyers not to represent them in the court.

র্যাব (RAB) প্রধান আইনজীবীদের উদ্দেশ্যে বলেছেন, জঙ্গীদের পক্ষে আদালতে যেন আইনজীবিরা না দাঁড়ায়। কয়েকদিন আগে এই র্যাব প্রধানই নিরাপদ খাদ্য আইনটি সংসদে ফেরত পাঠিয়ে তাতে সর্বোচ্চ শাস্তি মৃত্যুদণ্ডের বিধান যোগ করার দাবী জানিয়েছিলেন। শুধু তাই নয় তিনি আরো বলেছিলেন, বাংলাদেশে মৃত্যুদণ্ডের নীচে কোন আইন রিয়্যাক্ট (কাজ) করেনা।
এমন একজন সরকারী আইন শৃঙ্খলা রক্ষাকারী বাহিনীর উর্ধতন কর্মকর্তা মৃত্যুদণ্ডের জন্য এবং অভিযুক্তকে আইনি সহায়তা না দেয়ার জন্য ওকালতি করছেন, যিনি আইন, রাষ্ট্র, নাগরিক অধিকার এই সব বিষয় নিয়ে মৌলিক বুঝই রাখেন না। র্যাবকে যেহেতু বাংলাদেশে সকলেই ভয় পায় তাই এই র্যাব প্রধানের হাস্যকর কথাবার্তাগুলো নিয়ে বাংলাদেশে কোন সমালোচনাও হয় না।
এখানে তার বক্তব্যের সমস্যা কোথায়?
আইনি সহায়তা পাওয়া যে কোন নাগরিকের মৌলিক সাংবিধানিক অধিকার। এই বক্তব্য দিয়ে র্যাব প্রধান নাগরিকের সাংবিধানিক অধিকার বঞ্চিত করার আহ্বান জানিয়েছেন ও নিজেকে সংবিধানের উর্ধে স্থাপন করেছেন। এটা সীমাহীন ধৃষ্টতা।
একজন আইনজীবী অভিযুক্তের পক্ষে যেই আইনি সহায়তা দেয় তা তাকে নির্দোষ প্রমাণের জন্য করেনা, আইনি সহায়তা দেয় অভিযুক্তের লিগ্যাল রাইট বা আইনী অধিকার প্রতিষ্ঠা করার জন্য যেটা তার সাংবিধানিক অধিকার।
একজন অভিযুক্তকে আদালতে তোলা হয় কেন? তোলা হয় তার অপরাধ প্রমাণের বা অপ্রমাণের জন্য। আদালতে অপরাধ প্রমাণের আগে তো অভিযুক্তকে নির্দোষ হিসেবে বিবেচনা করা হয়।
র্যাব প্রধান যাকে জঙ্গী হিসেবে অভিযুক্ত করে আদালতে পাঠায় সে নির্দোষও হতে পারে। সারা পৃথিবীতে প্রতিদিন অসংখ্য অভিযুক্ত মানুষ নির্দোষ হিসেবে আদালত থেকে ছাড়া পায়। রেব প্রধান এতে সন্তুষ্ট নয়। ক্রস ফায়ারে মেরে ফেলে, বাইরে থেকে ছিটকানি আটকে দিয়ে আত্মসমর্পণ করতে বলে হতভাগ্যদের গুলি বিস্ফোরণে উড়িয়ে দেয়ার পরেও যারা ভাগ্যগুণে বেঁচে আদালতে পর্যন্ত পৌঁছাতে পারে তাদের সাংবিধানিক আইনি অধিকারটুকুও র্যাব প্রধান কেড়ে নিতে চায়।
