After the hacking to death of Rifat Sharif in Barguna no lawyer is to defend his wife Ayesha Siddika Minni, who stands as an accused in the case. The bar association of Barguna has decided not to let any lawyer represent Ayesha in the court.
Some weeks ago, RAB chief Benajir Ahmed said that it would be suicidal if any lawyer defended any terror suspect in the court. In the case of killing of madrasa student Nusrat Jahan, lawyers of Feni Bar Association decided not to defend any of the accused. However, one lawyer decided to defend the accused. But, he was badly harassed by other lawyers who insisted that his defence in the case was immoral.
In Bangladesh in the case of some sensational cases the lawyers en masse decided not to stand on behalf of some defendants as well as plaintiffs. These lawyers ignore the rights of the defendants to defend themselves. Unless an accused is provided legal assistance the entire trial remains controversial. A lawyer should never be prejudiced and deny extending legal support to anyone.
A lawyer stands in support of an accused not to prove that he is innocent. The lawyer’s main role is to establish the legal rights of the accused. Those who do not have this basic concept of judiciary are not qualified to function as professional lawyers. This is very unfortunate that in Bangladesh people are forced to seek legal services from this sort of lawyers today.

বরগুণা হত্যাকাণ্ডে নিহত রিফাত শরীফের স্ত্রী আয়শা সিদ্দিকা মিন্নীর পক্ষে দাঁড়াননি বরগুণার কোন আইনজীবী। বরগুণা বার আয়শার পক্ষে আদালতে না দাঁড়ানোর সিদ্ধান্ত নিয়েছে এই অভিযোগ করেছেন তার পিতা।
এর আগে র্যা বের প্রধান বেনজীর আহমেদ জঙ্গীদের পক্ষে আইনজীবীদের দাঁড়ানো হবে আত্মঘাতী বলে মন্তব্য করেছিলেন। ফেনীতে মাদরাসা শিক্ষার্থী নুসরাত জাহান রাফি হত্যা মামলায় ফেনী বারের আইনজীবীরা বিবাদীর পক্ষে না দাঁড়ানোর সিদ্ধান্ত নিয়েছিলেন; তারপর একজন আইনজীবী সিদ্ধান্ত না মেনে নুসরাত হত্যা মামলায় বিবাদীপক্ষের হয়ে আদালতে দাঁড়ালে তাঁর সহকর্মীদের লাঞ্ছনা ও গঞ্জনার শিকার হন। সহকর্মীরা তাঁর নৈতিকতা নিয়ে প্রশ্ন তোলেন।
বাংলাদেশে প্রায়ই দেখা যায় এমন সেনসেশন্যাল মামলায় আইনজীবীরা দল বেঁধে এমন সিদ্ধান্ত নেয়। এই আইনজীবীরা ভুলে যায় ন্যায় বিচারের জন্য অভিযুক্তের আত্মপক্ষ সমর্থনের অধিকার থাকাটা অতি জরুরী। অভিযুক্ত পর্যাপ্ত আইনি সহায়তা না পেলে পুরো বিচার ব্যবস্থাটাই প্রশ্নবিদ্ধ হয়ে যায়।
একজন আইনজীবী কখনোই প্রেজুডিসের ভিত্তিতে কাউকে আইনি সহায়তা না দেয়ার সিদ্ধান্ত নিতে পারেন না। একজন আইনজীবি একজন অভিযুক্তকে নির্দোষ প্রমাণের জন্য আদালতে দাঁড়ান না; তিনি দাঁড়ান অভিযুক্তের লিগ্যাল রাইট প্রতিষ্ঠার জন্য। আইনি ব্যবস্থার এই মৌলিক বিষয় যারা জানেন না তাঁরা তো পেশাদার আইনজীবী হওয়ারই যোগ্য নয়। এমন আইনজীবীদের মাধ্যমেই বাংলাদেশের জনগণকে তাঁদের আইনি সহায়তা নিতে হয় আজকাল। এটাই দুর্ভাগ্যজনক।
